Am investigat motivul pentru care exist\u0103 at\u00e2t de pu\u021bine piste pentru biciclete, de ce calitatea acestora difer\u0103 at\u00e2t de mult \u0219i de ce nu exist\u0103 un cadru legislativ care s\u0103 \u00eencurajeze mersul pe biciclet\u0103 \u00een r\u00e2ndul publicului.<\/strong><\/p>\n\n\n\n<!--more-->\n\n\n\n<p>Un biciclist se deplaseaz\u0103 cu bicicleta pe o por\u021biune de drum recent renovat\u0103, pe pista destinat\u0103 bicicli\u0219tilor, dinspre centrul ora\u0219ului Cluj-Napoca spre cartierul M\u0103r\u0103\u0219ti. Tronsonul de drum arat\u0103 ca \u00eentr-un plan de urbanism: asfalt neted ca o mas\u0103 de biliard, o band\u0103 de autobuz cu marcaj impecabil, pavele de granit, platani proasp\u0103t planta\u021bi \u0219i o mic\u0103 pia\u021bet\u0103 \u00een fa\u021ba bisericii Sf\u00e2ntul Petru pentru cei care vor s\u0103 se odihneasc\u0103 \u00eentre cele dou\u0103 benzi aglomerate. Nu este nevoie de nici un panou, de pe fiecare centimetru p\u0103trat se vede cu ochiul liber c\u0103 aici s-au cheltuit mul\u021bi bani europeni \u00een numele dezvolt\u0103rii durabile.<\/p>\n\n\n\n<p>Pista pentru biciclete trece de pe carosabil pe trotuar \u00eenainte de o trecere de pietoni, iar dup\u0103 aproximativ 50 de metri \u2013 f\u0103r\u0103 niciun avertisment \u2013 se termin\u0103 odat\u0103 cu drumul renovat. Ciclistul aflat \u00een elan vireaz\u0103 instinctiv la st\u00e2nga spre carosabil. Doar norocul \u00eel salveaz\u0103 de a fi c\u0103lcat de un troleibuz care vine din spate cu vitez\u0103, silen\u021bios.<\/p>\n\n\n\n<p>Acest tronson este unul dintre pistele pentru biciclete ap\u0103rute \u00een ultimii ani \u00een centrul ora\u0219ului Cluj-Napoca, reabilitate din fonduri europene, care ar face mai atractiv\u0103 \u0219i mai sigur\u0103 deplasarea cu bicicleta \u00een acest ora\u0219 sufocat de ma\u0219ini. Doar c\u0103 aceste piste pentru biciclete sunt departe de a fi o re\u021bea coerent\u0103, sigur\u0103 \u0219i u\u0219or de utilizat de c\u0103tre toat\u0103 lumea. Prezentul articol se concentreaz\u0103 asupra situa\u021biei din Rom\u00e2nia \u0219i \u00eencearc\u0103 s\u0103 r\u0103spund\u0103 la o \u00eentrebare aparent simpl\u0103: cum este posibil ca niciun ora\u0219 din Rom\u00e2nia s\u0103 nu aib\u0103 o re\u021bea coerent\u0103 \u0219i de bun\u0103 calitate de piste pentru biciclete? Asta \u00een pofida faptului c\u0103<\/p>\n\n\n\n<ul><li>toat\u0103 lumea accept\u0103 \u00eencet-\u00eencet faptul c\u0103 utilizarea pe scar\u0103 larg\u0103 a bicicletei este esen\u021bial\u0103 pentru un transport durabil;<\/li><li>dezvoltarea infrastructurii pentru bicicli\u0219ti necesit\u0103 rareori interven\u021bii complexe \u0219i costisitoare, iar experien\u021ba \u0219i bunele practici occidentale sunt disponibile;<\/li><li>\u0219i acum exist\u0103 fonduri substan\u021biale disponibile pentru infrastructura de ciclism.<\/li><\/ul>\n\n\n\n<p>Acceptarea social\u0103 a mersului pe biciclet\u0103 este sc\u0103zut\u0103, accidentele de circula\u021bie sunt frecvente \u00een compara\u021bie cu alte \u021b\u0103ri din UE, iar guvernul \u0219i municipalit\u0103\u021bile rom\u00e2ne\u0219ti \u00eenc\u0103 v\u0103d pistele pentru biciclete ca ni\u0219te elemente de bifat, bune de promovat pe Facebook \u0219i \u00een diverse rapoarte, dar \u00een rest neesen\u021biale.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"642\" src=\"https:\/\/atlatszo.ro\/wp-content\/uploads\/2023\/01\/DSC00514-1024x642.jpg\" alt=\"Ker\u00e9kp\u00e1ros gy\u00fclekez\u0151 2022 utols\u00f3 critical mass-\u00e9n Kolozsv\u00e1ron. Este sf\u00e2r\u0219itul lui decembrie, vremea este rece \u0219i umed\u0103<\/em><\/figcaption><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Nici m\u0103car nu merit\u0103 men\u021bionate \u00een statistici<\/strong><\/h2>\n\n\n\n<p>Datele privind folosirea bicicletei nu sunt u\u0219or de ob\u021binut, dar sunt disponibile totu\u0219i c\u00e2teva studii. \u00cen compara\u021bie cu alte state europene, rata de utilizare a bicicletei \u00een \u021bar\u0103 este sc\u0103zut\u0103, fiind de aproximativ 6%. Un sondaj realizat pentru Agen\u021bia de Dezvoltare Regional\u0103 Sud-Est \u00een 2018-19 a constatat cifre similare: 5% dintre responden\u021bi indic\u00e2nd c\u0103 bicicleta este modul lor preferat de transport. Ce-i drept, \u00een zona rural\u0103 cifra este mai mare, ridic\u00e2ndu-se la aproape 9%.<\/p>\n\n\n\n<p>13-14% dintre responden\u021bi folosesc bicicleta ca mijloc de transport zilnic (\u00een compara\u021bie cu 20% \u00een zonele rurale). \u00cen acela\u0219i timp, 41% dintre responden\u021bi folosesc bicicleta pentru activit\u0103\u021bi recreative.<\/p>\n\n\n\n<p>\u0218i, de\u0219i nu exist\u0103 date oficiale privind bicicli\u0219tii din Rom\u00e2nia, datele Institutului Na\u021bional de Statistic\u0103 (INS) arat\u0103 c\u0103 num\u0103rul gospod\u0103riilor \u00eenzestrate cu biciclete a crescut \u00eentre 2012 \u0219i 2021. \u00cen timp ce \u00een 2012 30% din gospod\u0103rii de\u021bineau o biciclet\u0103, \u00een 2021 procentul s-a ridicat la 47% (datele de mai sus au fost colectate din <a href=\"https:\/\/drive.google.com\/file\/d\/1qLZUJpN8mC1dZs9Zu6hTNGvPfUqUnd_F\/view?usp=sharing\" target=\"_blank\" rel=\"noreferrer noopener\">Primul Plan Na\u021bional Velo al Rom\u00e2niei<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Utilizarea bicicletei reprezint\u0103 un element cheie al tranzi\u021biei verzi<\/strong><\/h2>\n\n\n\n<p>Dar deplasarea cu bicicleta, ca element important al circula\u021biei urbane sustenabile este esen\u021bial\u0103 dac\u0103 factorii de decizie ai Uniunii Europene iau \u00een considerare cu seriozitate unul din <a href=\"https:\/\/climate.ec.europa.eu\/eu-action\/european-green-deal_en\" target=\"_blank\" rel=\"noreferrer noopener\">elementele cheie ale Green Deal<\/a>, adic\u0103 reducerea emisiilor de gaze cu efect de ser\u0103 cu 55% p\u00e2n\u0103 \u00een 2033, comparativ cu nivelurile din 1990 \u0219i asigurarea neutralit\u0103\u021bii climatice a Uniunii Europene p\u00e2n\u0103 \u00een 2050.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>\u201eVom ajunge la un nou nivel\u201d \u2013 a promis <a href=\"https:\/\/ec.europa.eu\/commission\/commissioners\/2019-2024\/valean\/team_en\" target=\"_blank\" rel=\"noreferrer noopener\"><u>Charlotte N\u00f8rlund-Matthiessen<\/u><\/a>, consiliera comisarului european pentru transporturi, Adina V\u0103lean, de ziua mondial\u0103 a bicicletei de anul trecut (World Bicycle Day 2022) la masa rotund\u0103 organizat\u0103 cu aceast\u0103 ocazie. Dup\u0103 Matthiesen, noul plan cadru de mobilitate urban\u0103 (Urban Mobility Framework) este revolu\u021bionar pentru c\u0103 pune \u00een prim-plan deplasarea cu bicicleta \u0219i mersul pe jos.<\/p><\/blockquote>\n\n\n\n<p>Frans Timmermans, comisarul european responsabil pentru tranzi\u021bia verde, <a href=\"https:\/\/transport.ec.europa.eu\/news\/efficient-and-green-mobility-2021-12-14_hu\" target=\"_blank\" rel=\"noreferrer noopener\"><u>a vorbit<\/u><\/a> despre inov\u0103ri radicale similare: \u201eTranzi\u021bia verde \u0219i digital\u0103 a Europei va \u00eensemna schimb\u0103ri majore pentru transporturi. Propunerile de ast\u0103zi vor pune mobilitatea european\u0103 pe drumul c\u0103tre un viitor durabil: c\u0103l\u0103torii mai rapide pe calea ferat\u0103, cu bilete u\u0219or de cump\u0103rat (&#8230;) sprijin pentru ora\u0219e \u00een vederea \u00eembun\u0103t\u0103\u021birii transportului public \u0219i a infrastructurii pentru pietoni \u0219i bicicli\u0219ti.(&#8230;).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Bicicleta e o juc\u0103rie <\/strong><strong>pentru<\/strong><strong> copii<\/strong><\/h2>\n\n\n\n<p>Cu toate c\u0103 politicienii din \u021bar\u0103 nu sunt la fel de entuzia\u0219ti \u00een privin\u021ba mersului pe jos \u0219i a mersului pe biciclet\u0103 ca cei de la Bruxelles, se pare \u2013 cel pu\u021bin \u00een ceea ce prive\u0219te declara\u021biile \u2013 c\u0103 toat\u0103 lumea este \u00een favoarea transportului durabil, inclusiv a dezvolt\u0103rii ciclismului. Cu toate acestea, \u00eentrebarea este ce \u00een\u021belegem prin promovarea mersului pe biciclet\u0103 \u0219i c\u00e2t de mult sunt dispu\u0219i diferi\u021bii actori din administra\u021bia public\u0103 s\u0103 \u00ee\u0219i schimbe radical abordarea fa\u021b\u0103 de acest mod de deplasare.<\/p>\n\n\n\n<p>A existat de mult timp, \u0219i \u00een unele locuri \u00eenc\u0103 s-a p\u0103strat, ideea c\u0103 bicicleta este o juc\u0103rie pentru copii, un exerci\u021biu fizic pl\u0103cut care poate fi practicat duminica \u00een parcul ora\u0219ului pe vreme frumoas\u0103, ne-au spus urbani\u0219tii cu care am vorbit \u00een timpul document\u0103rii acestui material. Lista lung\u0103 de ini\u021biative de reglementare e\u0219uate, jum\u0103t\u0103\u021bi de solu\u021bii \u0219i interdic\u021bii absurde privind bicicli\u0219tii \u0219i infrastructura pentru bicicli\u0219ti \u00eentr-o etap\u0103 sau alta arat\u0103 dorin\u021ba real\u0103 de a crea un cadru juridic care s\u0103 \u00eencurajeze mersul pe biciclet\u0103, s\u0103 trateze bicicli\u0219tii ca parteneri egali cu ma\u0219inile \u0219i s\u0103 promoveze dezvoltarea unei infrastructuri sigure pentru bicicli\u0219ti.<\/p>\n\n\n\n<p>S\u0103 \u00eencepem legisla\u021bia privind mersul pe biciclet\u0103. Aceast\u0103 legisla\u021bie poate fi \u00eemp\u0103r\u021bit\u0103 \u00een dou\u0103 categorii: legisla\u021bie specific\u0103 pentru bicicli\u0219ti \u0219i legisla\u021bie \u00een alte domenii care include \u0219i prevederi pentru bicicli\u0219ti.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>A fost nevoie de 20 de ani s\u0103 fie elaborat\u0103 \u0219i tot n-a ie\u0219it cum trebuie<\/strong><\/h2>\n\n\n\n<p><a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/253521\" target=\"_blank\" rel=\"noreferrer noopener\">Hot\u0103r\u00e2rea nr. 441\/2022<\/a> privind crearea, amenajarea \u0219i omologarea traseelor de cicloturism publicat\u0103 anul trecut \u00een martie care are originile \u00eenc\u0103 prin 1999 (<a href=\"https:\/\/ccncluj.blogspot.com\/2008\/03\/reteaua-nationala-de-trasee.html\" target=\"_blank\" rel=\"noreferrer noopener\">cronologia din 2008 este disponibil\u0103 aici<\/a>, proiectul av\u00e2nd deja la aceast\u0103 dat\u0103 un trecut sinuos). Aceast\u0103 hot\u0103r\u00e2re de guvern este important\u0103 pentru c\u0103 va sta la baza \u00eenceperii marc\u0103rii pistelor pentru biciclete \u00eentre localit\u0103\u021bi care vor fi ulterior conectate la re\u021beaua de piste ROVELO care va fi legat\u0103 la r\u00e2ndul ei de re\u021beaua european\u0103 de piste EUROVELO.<\/p>\n\n\n\n<p>De\u0219i aceast\u0103 hot\u0103r\u00e2re de guvern este un pas important, ONG-urile din domeniul cicloturismului nu sunt mul\u021bumite. A existat o versiune agreat\u0103 anterior de c\u0103tre ONG-uri, dar \u00een ultimul moment au fost aduse modific\u0103ri importante la aceasta f\u0103r\u0103 consultare. \u00cen prezent, decizia prezint\u0103 numeroase inconsecven\u021be \u0219i deficien\u021be terminologice.<\/p>\n\n\n\n<p> Din p\u0103cate au ap\u0103rut \u00eentr-o form\u0103 care e foarte mult schimbat\u0103 \u00een r\u0103u fa\u021b\u0103 de forma care era oarecum agreat\u0103 de ani de zile de Ministerul Turismului \u0219i alte ministere \u0219i blocat\u0103 de Ministerul de Interne. Pe urm\u0103 nu au consultat cu nimeni, s-au rupt toate firele de comunicare din prim\u0103vara anului trecut, de c\u00e2nd s-a \u00eenceput lucrul la PNRR. Foarte pu\u021bine dintre <a href=\"https:\/\/drive.google.com\/file\/d\/1jVAZ4Tz_GX5oq5LFbwThxzyolXp2sc4k\/view\" target=\"_blank\" rel=\"noreferrer noopener\">observa\u021biile noastre<\/a> au fost agreate \u2013 ne-a spus Radu Mitirean, pre\u0219edintele Federa\u021biei Bicicli\u0219tilor din Rom\u00e2nia. S-a zis c\u0103 detaliile se vor stabili prin ordin de ministru, acest ordin trebuia publicat \u00een 180 de zile.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Clarificare terminologic\u0103 pripit\u0103<\/strong><\/h2>\n\n\n\n<p>Tot anul trecut a fost adoptat\u0103 <a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocumentAfis\/253862\" target=\"_blank\" rel=\"noreferrer noopener\">Legea 85\/2022<\/a>: aceast\u0103 lege modific\u0103 hot\u0103r\u00e2rea de guvern privind drumurile \u0219i introduce defini\u021bia de <em>drum pentru cicli\u0219ti<\/em>. Acest lucru reprezint\u0103 un oarecare progres, deoarece, p\u00e2n\u0103 acum, \u00een legisla\u021bia na\u021bional\u0103 se cuno\u0219tea doar pista de biciclete care putea acoperi orice, de la o band\u0103 marcat\u0103 pe marginea drumului p\u00e2n\u0103 la o pist\u0103 pentru bicicli\u0219ti care se desf\u0103\u0219oar\u0103 de-a lungul trotuarului sau paralel cu drumul, separat de acesta. Activi\u0219tii sus\u021bin c\u0103 de\u0219i inten\u021bia legii este bun\u0103, dar realizarea concret\u0103 este \u201eheirupist\u0103\u201d cu multe \u0219i destul de grave deficien\u021be.<\/p>\n\n\n\n<p>Deci, \u00een loc s\u0103 fie un pas important \u00eenainte, nu face dec\u00e2t s\u0103 creeze mai multe probleme. Organiza\u021biile se pl\u00e2ng, de asemenea, c\u0103 nu au fost consultate cu privire la acest proiect. La ini\u021biativa ONG-urilor, \u00een 2017 diferite partide parlamentare au \u00eencercat <a href=\"https:\/\/www.cdep.ro\/relatii_publice\/site2015.text_presa?pid=14021\" target=\"_blank\" rel=\"noreferrer noopener\">elaborarea unei<\/a> \u201elegi a bicicletelor\u201d. S-a format un grup de lucru \u00een Camera Deputa\u021bilor, dar ini\u021biativa a e\u0219uat \u00een ciuda declara\u021biilor de pres\u0103 entuziaste.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Pistele de biciclete se proiecteaz\u0103 conform standardelor din anii \u201890?<\/strong><\/h2>\n\n\n\n<p>Ministerul Dezvolt\u0103rii lucreaz\u0103 din 2016 la <a href=\"https:\/\/mdlpa.ro\/pages\/proiectordinaprobareaghidproiectareinfrstructurabiciclete\" target=\"_blank\" rel=\"noreferrer noopener\"><u>un ordin<\/u><\/a> privind proiectarea infrastructurii de cicloturism. Proiectul a fost publicat pe site-ul ministerului \u00een august 2020, dar nu se \u0219tie c\u00e2nd va fi adoptat.<\/p>\n\n\n\n<p>Aceast\u0103 lege ar fi important\u0103, deoarece ar putea oferi \u00een sf\u00e2r\u0219it inginerilor, arhitec\u021bilor \u0219i urbani\u0219tilor orient\u0103ri clare atunci c\u00e2nd proiecteaz\u0103 trasee pentru biciclete. \u00cen prezent, exist\u0103 doar c\u00e2teva standarde (STAS) \u00eenvechite din anii \u201890.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Cerin\u021be de licita\u021bie<\/strong><\/h2>\n\n\n\n<p>Lipsa standardelor de proiectare a infrastructurii pentru biciclete duce la situa\u021bii ciudate. Spre exemplu, anul trecut \u00een octombrie, Ministerul Mediului a publicat <a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/259886\" target=\"_blank\" rel=\"noreferrer noopener\">un ghid de finan\u021bare indic\u00e2nd cerin\u021bele minime<\/a> pe care trebuie s\u0103 le \u00eendeplineasc\u0103 pistele de biciclete realizate de prim\u0103rii din ace\u0219ti bani.<\/p>\n\n\n\n<p>\u201eEste \u0219i foarte prost scris, n-a fost respectat\u0103 transparen\u021ba decizional\u0103, dar totu\u0219i, m\u0103car au pus ni\u0219te minime condi\u021bii pentru l\u0103\u021bime de 1,5 m. Dac\u0103 nu ar fi introdus aceste condi\u021bii, exista pericolul s\u0103 se construiasc\u0103 piste de 50 cm.\u201d \u2013 a explicat Mititean.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>\u201eAceasta nu este legisla\u021bie, dar \u021bi-o pun eu ca o condi\u021bie de oportunitate a finan\u021batorului. Vreau s\u0103 le faci a\u0219a \u0219i \u021bi le pl\u0103tesc. Dar nu e o chestie normal\u0103, pentru c\u0103 atunci \u00een func\u021bie de sursa de finan\u021bare vor fi criterii diferite, \u00een func\u021bie de cum ai convins ADR-ul, ministerul, organismul intermediar etc. Sau dac\u0103 fac din fonduri proprii, atunci pot s\u0103 fac cum vreau c\u0103 n-am nici o constr\u00e2ngere.\u201d \u2013 a spus activistul.<\/p><\/blockquote>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Dac\u0103 nu <\/strong><strong>este reglementat, nu poate fi ilegal<\/strong><\/h2>\n\n\n\n<p>Potrivit activi\u0219tilor cu care am discutat, lipsa unor orient\u0103ri clare privind infrastructura pentru biciclete \u00eenseamn\u0103 c\u0103 multe administra\u021bii publice realizeaz\u0103 piste de biciclete deloc potrivite pentru ciclism, care sunt periculoase sau pur \u0219i simplu ignor\u0103 nevoile reale.<\/p>\n\n\n\n<p> Aceste piste de biciclete arat\u0103 bine \u00een fotografii \u0219i statistici, dar calitatea \u0219i utilitatea lor este \u00eendoielnic\u0103. Lipsa legisla\u021biei \u00eenseamn\u0103 c\u0103 astfel de proiecte nu pot fi atacate nici m\u0103car \u00een instan\u021b\u0103. La noi instan\u021bele de contencios administrativ nu au voie s\u0103 se pronun\u021be pe oportunitate, eficien\u021b\u0103, doar pe legalitate. Sunt foarte multe ini\u021biative blocate. Majoritatea blocajelor vin dinspre Ministerul de Interne. Ei cam reu\u0219esc s\u0103 blocheze peste tot \u0219i fac presiuni \u0219i asupra altor autorit\u0103\u021bi \u0219i ministere s\u0103 nu aprobe.\u201d \u2013 a explicat Radu Mititean.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Dac\u0103 nu exist\u0103 bicicli\u0219ti, nu sunt nici accidente<\/strong><\/h2>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>Potrivit activistului, respingerea rigid\u0103 a Ministerului de Interne se datoreaz\u0103 \u201eabord\u0103rii mili\u021biene\u0219ti\u201d a unor angaja\u021bi din minister. \u201eEi spun c\u0103 Rom\u00e2nia este de foarte mul\u021bi ani num\u0103rul 1 sau 2 \u00een Europa ca procent de bicicli\u0219ti mor\u021bi la suta de km parcur\u0219i. Cum s-au g\u00e2ndit ei s\u0103 \u00eembun\u0103t\u0103\u021beasc\u0103 aceast\u0103 statistic\u0103, s\u0103 rezolv\u0103m problema? Cu c\u00e2t mai pu\u021bini bicicli\u0219ti, cu at\u00e2t mai pu\u021bine accidente! Din punctul lor de vedere, dac\u0103 dispar bicicli\u0219tii, dispar \u0219i accidentele \u0219i am rezolvat problema.\u201d \u2013 spune Mititean.<\/p><\/blockquote>\n\n\n\n<p>Este important de remarcat faptul c\u0103 Rom\u00e2nia este practic \u021bara cu cel mai mare num\u0103r de decese \u00een r\u00e2ndul bicicli\u0219tilor din UE. Doar Olanda se afl\u0103 \u00eenaintea acesteia, probabil pentru c\u0103 acolo sunt mult mai mul\u021bi bicicli\u0219ti dec\u00e2t media UE.<\/p>\n\n\n\n<p>De altfel, <a href=\"https:\/\/etsc.eu\/wp-content\/uploads\/PIN-Flash-38_FINAL.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><u>conform datelor din 2020 a Consiliului European pentru Siguran\u021ba Transporturilor (ETSC) <\/u><\/a>anual, la nivelul Uniunii Europene, \u00ee\u0219i pierd via\u021ba \u00een accidente rutiere circa 5 mii de pietoni \u0219i 2 mii de bicicli\u0219ti, fiind de departe categoria cea mai vulnerabil\u0103. Cu toate c\u0103 siguran\u021ba pietonilor a crescut cu 20% \u00een ultimii 10 ani, num\u0103rul deceselor cauzate de accidente \u00een care sunt implica\u021bi cicli\u0219ti nu a sc\u0103zut din 2010.<\/p>\n\n\n\n<p>Dar s\u0103 revenim la legisla\u021bie. Nici legisla\u021bia care reglementeaz\u0103 \u00een principiu alte domenii nu \u00eencurajeaz\u0103 mersul pe biciclet\u0103.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Dup\u0103 litera legii, <\/strong><strong>nu te po\u021bi da cu bicicleta nic\u0103ieri<\/strong><\/h2>\n\n\n\n<p>Una din faimoasele dispozi\u021bii din <a href=\"https:\/\/legeaz.net\/PdfDoc\/noul-cod-rutier.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><u>Codul rutier<\/u><\/a> le interzice, de exemplu, explicit copiilor sub 14 ani folosirea bicicletelor pe drumurile publice. De asemenea, acesta \u00eei oblig\u0103 pe bicicli\u0219ti s\u0103 foloseasc\u0103 o pist\u0103 pentru bicicli\u0219ti dac\u0103 aceasta exist\u0103 pe o anumit\u0103 por\u021biune de drum \u2013 chiar dac\u0103, \u00een realitate, aceasta este inutilizabil\u0103 sau periculoas\u0103. Aceast\u0103 dispozi\u021bie este neobi\u0219nuit\u0103 \u0219i deoarece, de exemplu, siturile Natura 2000 sunt, de asemenea, zone protejate \u0219i exist\u0103 adesea a\u0219ez\u0103ri \u00een aceste zone. Prin urmare, cicloturismul ar fi interzis \u00een aceste localit\u0103\u021bi.<\/p>\n\n\n\n<p>\u00cen mod paradoxal, aceast\u0103 lege este mai permisiv\u0103 fa\u021b\u0103 de utilizatorii de ATV-uri: ace\u0219tia pot intra cu permisiunea administratorului zonei protejate, dar bicicli\u0219tii nu pot nici m\u0103car s\u0103 \u00eei solicite acordul conform legii. \u0218i ca s\u0103 complet\u0103m lista: \u00een principiu, bicicletele nu au voie pe p\u0103\u0219uni \u0219i nici pe drumurile care traverseaz\u0103 terenuri agricole, precizeaz\u0103 Radu Mititean.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Important e s\u0103 arate bine \u00een statistici<\/strong><\/h2>\n\n\n\n<p>F\u0103r\u0103 o reglementare uniform\u0103 \u0219i cuprinz\u0103toare, proiectan\u021bii, autorit\u0103\u021bile beneficiare \u0219i autorit\u0103\u021bile care aprob\u0103 proiectele se afl\u0103 pe un teren fluid atunci c\u00e2nd reg\u00e2ndesc utilizarea spa\u021biului public \u0219i doresc s\u0103 adauge infrastructur\u0103 pentru bicicli\u0219ti pe o por\u021biune de drum conceput\u0103 anterior pentru traficul auto \u0219i pietonal.<\/p>\n\n\n\n<p>\u201eTotul se face a\u0219a cum vrea mu\u0219chiul primarului\u201d \u2013 a exclamat activistul ciclist c\u00e2nd a fost abordat subiectul. Dup\u0103 Mititean, bunele practici adoptate \u00een \u021b\u0103rile occidentale ar putea fi aplicate \u00een Rom\u00e2nia \u0219i \u00een lipsa unei legisla\u021bii \u00een acest sens, dar nu exist\u0103 voin\u021b\u0103 politic\u0103.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>\u201eLa noi nu s-a f\u0103cut nimic, sau s-au f\u0103cut ni\u0219te lucruri a\u0219a, pentru statistic\u0103, s\u0103 dea bine. S\u0103 zicem \u0219i noi c\u0103 avem, au fost ni\u0219te fonduri UE pentru a\u0219a ceva. Dar la calitate au zis, a, nu ne oblig\u0103 nici un normativ. Atunci apar piste care par photoshop pentru cei din Vest.<\/p><p>A\u0219a e sistemul, dac\u0103 (proiectan\u021bii) nu proiecteaz\u0103 cum vor ei, g\u0103sesc pe altul care o s\u0103 accepte. Tudor P\u0103nescu \u0219i Tiberiu Ciolacu nu au sesizat nici un fel de presiune din partea beneficiarilor cum sus\u021bine Radu Mititean.<\/p>\n\n\n\n<p>\u201eDe regul\u0103, nu se \u00eent\u00e2mpl\u0103 ca o prim\u0103rie s\u0103 spun\u0103 \u201dvreau o pist\u0103 de 80 cm\u201d, adic\u0103 subdimensionat\u0103. Multe dintre pistele pentru biciclete de-a lungul grani\u021belor cu Ungaria \u0219i Bulgaria au fost finan\u021bate prin proiecte de cooperare transfrontalier\u0103 (Interreg). Autorit\u0103\u021bile jude\u021bene \u0219i locale au fost eligibile s\u0103 aplice pentru aceste fonduri.<\/p>\n\n\n\n<p>Cu toate acestea, oportunitatea AFM eclipsat\u0103 de resursele disponibile din Planul Na\u021bional de Redresare \u0219i Rezilien\u021b\u0103 (PNRR). \u00cen cadrul acestuia, Rom\u00e2nia s-a angajat s\u0103 construiasc\u0103 3.000 km de piste pentru biciclete \u00een afara zonelor urbane. Sub egida tranzi\u021biei spre transportul durabil, \u0219i \u00een localit\u0103\u021bi vor fi construite piste pentru bicicli\u0219ti, dar aici nu exist\u0103 nicio promisiune privind lungimea acestora.<\/p>\n\n\n\n<p>Modul \u00een care dezvoltarea infrastructurii pentru bicicli\u0219ti a fost inclus\u0103 \u00een Planul Na\u021bional de Redresare \u0219i Rezilien\u021b\u0103 ilustreaz\u0103 clar modul \u00een care deciziile de politic\u0103 public\u0103 din Rom\u00e2nia sunt luate pe baza unor decizii personale \u0219i a unor coinciden\u021be fericite, mai degrab\u0103 dec\u00e2t pe baza unor strategii.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Ministrul a introdus personal partea legat\u0103 de ciclism \u00een documenta\u021bie<\/strong><\/h2>\n\n\n\n<p>De fapt, aceste angajamente au fost introduse \u00een documenta\u021bie personal de <a href=\"https:\/\/ro.wikipedia.org\/wiki\/Cristian_Ghinea\" target=\"_blank\" rel=\"noreferrer noopener\"><u>Cristian Ghinea<\/u><\/a>, ministrul Fondurilor Europene la vremea respectiv\u0103.
